Traditional advertising laws still apply when AI is involved. If you sell prepared food, you need to show that food. If you show people as a key part of your marketing, you may need to mention when those people are AI-generated.
AI-generated content should never exaggerate product performance, fabricate customer testimonials, invent reviews, or create misleading demonstrations.
Businesses remain legally responsible for every marketing claim they publish, regardless of whether it was written by an employee or generated by AI. This is one of the main reasons all content written for blogs or emails should be reviewed by a knowledgeable person.
Voice and Likeness
AI now makes it possible to replicate voices, faces, and appearances with remarkable realism.
Using another person’s likeness, voice, or identity without permission may violate state right-of-publicity laws, privacy laws, intellectual property rights, or consumer protection statutes.

If your company works with NDAs that prohibit sharing certain information, then uploading that information to AI may not be legally permitted.
Protecting customer privacy remains the responsibility of the business, not the AI provider.
Large language model (LLM) AI uses content from the Internet as part of its base for learning and generating content. Any content you upload, along with copyrighted material on the internet, may influence the content AI generates for you. This creates copyright concerns when brands and intellectual property are used by AI systems and the proper owners are not compensated accordingly.
If you use AI for content creation, you need to review the content to ensure you are not unknowingly copying another person’s copyrighted material.
As creatives, we are adamantly opposed to the harm caused when AI systems take from the hardworking creative community without proper permission or compensation.
Human Accountability
Perhaps the most important legal principle is this:
AI cannot accept legal responsibility.
If AI generates inaccurate information, misleading advertisements, copyright violations, or defamatory content, the business is generally responsible for what is ultimately published.
